    Its true that Consulting companies take a good part of your BILL-RATE but other stuffs may not be THAT bad.

    I'm working thru such a small company for last 3 years and this is my 4th client... 3 of the 4 clients were provided by them, no bench so far. They dont give me BillRate share but we work with a Negotiated Resonable salary based on the Cost of Living of the City where i work/consult for.....

    Discuss the Terms and put in email as well as Paper before Joining - Be on Top of them even if they want to change a single spelling in that Terms Paper. You got to be very tough , aggressive as well as resistive with them for any changes they want to script against you.

    I have been working for state government from past 3 years (approx) under a non-caped H1b with EB2 2006 labor cleared and i-140 pending and 485 filed in aug.
    Considering the constraints of non-cap h1b , I asked a consultant to apply for my caped h1b in april. At that time 485 was not current and according to my estimation my PD would not have become current for 2-3 years more, so I thought of moving with a caped h1b to private firm. You all know what happened in july regarding 485.

    Recently my caped H1b got approved. Since I have already filed for 485, I have decided to be with present firm for 6 months then think of changing using the new caped h1b and AC21 to private firm through consultant.

    But I have heard that when one works for consultant, its easy not to get paid for certain months during project transition or while looking for project. With the result�.its affects the H1b status. Now that my immigration status is clean, is it worth moving to consultant and risk my clean status�??? Is working for consultant a big compromise against immigration status�??? Also i need to look for a job identical to my labour. I� m basically into web and database application in sql server 2005 , asp.net with ajax. What�s the market for these skill looks like�????

    I just got some *#&$ about thanking me for supporting her blue card and AgJOBS initiatives, with not a mention on tackling retrogression issues.

    I presume her change of status (COS) from H4 to H1 took place automatically when she received her I-797 Approval notice from CIS with an I-94 valid till Oct 2011. Is my presumption correct?

    Now, will her next COS i.e. from H1 to H4 take place when she leaves the US and appears for H4 interview based on my current H1's (company B's) 1-797 Approval notice in consulate in India? [

    Your wife will be applying for a new H-4 visa, but it's not called a COS. That just applies when a person applies to change status while remaining in the US.

    I dont have stamp of my current H1 (company B's) in my passport. I have only the old H1 stamp (company A's) in my passport, which is already expired. I also plan to leave for India for my H1 stamping. Which will be the better approach: she appearing for her H4 interview along with me when I appear for my H1 stamping or she going alone ahead of me for her H4 stamping? Many thanks in advance.

    Either is OK. Once you have H-1B status it doesn't matter that you don't have a valid H-1B visa

    I agree with smuggy, we do not fight hard to get money because
    We don't really work that hard to make that money, If you worked during your undergraduate years in slaughter houses like McDonalds and Pizza hut, you would know what the value of money today, most of them are paid by their parents,
    Most of the desis are creative but lazy at work (esp. people in my company), so they work long hours, Can not read complicated text, especially from Insurance companies
    and some of them are look backwards as lawsuits are taboo, terrible balance between work and life, procrastination, and finally, not understanding of how to make use of simple, dummy proof American legal system to solve tiny and simple problems like insurance payments and rejections.

    ... would be to outsource the mundane clerical work to a more efficient *on-shore* processing firm, and web-enable most services, remove repetitive submission of same documents with every single application, and provide customer access to his/her immigration profile & docs online (so we don't have to carry around the history of our lives on paper.... wherever we move... ).

    It would probably be OK... but as you've rightly guessed, and given the fact that USCIS hasn't really outlined any plans to demonstrate how the extra money will be spent and whether it will guarantee better and faster service measured by a dramatic reduction in processing times, this money is probably going towards enforcement.

    It's probably DHS getting the money (not USCIS directly - the checks I wrote were for DHS, iirc).

    Case: H1B transfer Denial

    One of my friends H-1B transfer got denied. The case is he has a H-1(under masters quota) from Oct 2008 with a previous employer and got a new job from Jan 2009 so applied for a transfer thru them. He has been working from last July2008 and has all the paystubs from july2008-dec2008. So applied the transfer with all the paystubs. He got an RFE in March asking to provide W-2 for last year , paystubs , client letters etc. After replying to RFE after 1 month got a denial from USCIS in the website. HE is still waiitng for formal letter from them. So wat are the options available ??
    Can he go back to previous employer ?
    Can he file a motion on why they rejected the transfer? If even the motion gets rejected can we still go back to previous employer ?
    Please let me know it is kind of urgent...

    Hi,

    I would like to understand more clearly what would happen for my EB3 485 case if it gets approved meanwhile and I'm still waiting for EB2 to becoming current to apply for 485. Will USCIS reject my Eb3 application saying I have a pending EB2 application for AOS.


    I will put a ficticious case.

    EB3 India PD March 2005
    I140 approved June 2007
    Applied for 485 on July 2nd 2007.

    Meanwhile say in Nov 2007 I file for a fresh EB2 case

    and USCIS sends me approval notice for already filed EB3 case in Nov 2007

    What will happen then.

    "To speed up processing" seems like a standard reply for anyone whose case is transferred.
    Once it is transferred, you may get the status message that says- "it is following normal processing time"

    Hi,

    I am currently in the 6th year of my H1B. My visa is going to expire in at the end of December. Is it too late for me to start applying for the green card? If it is not too late, what is my status going to be after December if I do apply for the green card now? Also, I have heard that I have to apply a year before my visa expires, is it too late now? Please help! Your response is greatly appreciated!

    I am from Hong Kong, SAR. I have never applied for labor cert. For the past six years, I have just been on H1B visa.

    Normally the consulate in Canada or Mexico will only entertain an application if the person graduated from a school in the US. The reason being that they can verify the genuineness of the education which is not possible in a situation where the person went to a school in a different country. But if you are already in the US in H-1B status and have a H-1B visa in the passport then you have a better chance of getting a visa.

    Yes. Its up to the VO to grant the period of stay. You could enter US even with one day left on the visa. Once you are on US soil, its I-94 that determines the duration of your stay (which has expiry date).

    IMHO, that's a big risk as you will never know if the IO just gives for a month, 2 months or 6 months.

    There is the risk of getting stuck in security processing if you apply for another visa as shared by another member.

    For your friend's case s/he needs to weigh these risks and see which one s/he can take.
