Hi Rosebell,
Thanks for the reply. How to show that labor is pending for more than one year? How to get a proof for that? Can I get it from any website?

The Swine Flu saga continues. Mexico reported three new deaths from the swine flu epidemic Saturday and urged citizens not to let their guard down against a virus that has killed 19 in people in Mexico and is spreading across Asia and Europe.
Health Secretary Jose Angel Cordova said Mexico's confirmed swine flu cases jumped to 473, including the 19 deaths. The previous death toll in Mexico was 16. A Mexican toddler also died in Texas days ago, for a worldwide total of 20.
In accordance with measures announced by the Government of Mexico to limit the congregation of large crowds to prevent the spread of the H1N1 virus, the U.S. Embassy in Mexico City and the U.S. Consulate General in Ciudad Juarez advise that most consular services are being suspended. The dates listed below may change. The Embassy and Consulate General will monitor the H1N1 situation continuously during the week and will update information on our website if the dates of the suspension of service change.
Immigrant Visa operations in Ciudad Juarez have been suspended from April 30 to May 8. Immigrant visa and waiver applicants who have April 29 appointments should proceed to the Consulate. The panel physicians are closed. Those applicants who have consular immigrant visa appointments after May 8 and have not yet obtained their medical exams should not come to Juarez until the panel physicians have re-opened.
All non-immigrant visas operations in Mexico have been suspended until May 6.
Consular services for U.S. citizens throughout Mexico will be limited to emergency assistance and to citizenship applications (passports and consular reports of birth abroad, or CRBA). Anyone with passport or CRBA appointments are encouraged but not required to reschedule to a later date. For more complete information on consular operations during the flu outbreak, as well as the latest travel advisory and warden messages, visit http://ciudadjuarez.usconsulate.gov/h1n1.html. If the H-1 was filed as a COS you will have to join the H-1 company on October 1, as you will no longer be on L-1 on that date. If you H-1 is filed for consular processing, then you dont have to worry, whenever you are ready you can go to the consulate in your home country, get a visa and come back on H-1b status.

While driving back , at POE the process is simple. Always show your AP before passport and they will let you in. Never show the passport before the AP.

I got a letter from Zoe Lofgren's office, who is a Member of Congress representing California 16th District, in response to one of our web faxes on H-1B cap and GC backlogs. Below is the complete text from the letter -- it's heartening to know we are on their radar at least!
Now that we got their attention, is there anything we should do to follow up on this now?

Thank you for contacting me. I appreciate the time you took to explain the impact of the H-1B visa cap and the "green card" backlog on U.S. employers.
I understand well that the success of U.S. companies depends on highly educated and talented U.S. citizens and foreign nationals.
What we need is thoughtful reform that supports the American economy and allows American companies the benefit of the "best and brightest" from around the world.
As you know, the Republicans now lead in the House of Representatives, Senate, and White House. As such, Republicans control what bills and amendments are considered in committees and on the floor of the House of Representatives. They have taken no action for reform but have proposed legislating on a money bill in violation of House rules. Should Senate Judiciary Committee's H-1B proposal come before me in the House of Representatives, I will certainly consider your point of view.
Again, thank you for contacting me. Please do not hesitate to contact me again if can be of further assistance to you or your family.
Sincerely,
Zoe Lofgren
Member of Congress

You can still get a 1 year extension claiming that your PERM application is still pending. It all depends on the officer that the decision has not been made on PERM application.
How he can claim that "PERM application is still pending" when it's already denied!!! :)

Hi,
My wife filed her LC under EB3 with June 2003 priority date and I filed my LC under EB2 with Feb 2005 Prority date. Later, I had a job change, in the same company and had to re-do my LC/I-140 -- this time the LC was filed in Nov 2006. My lawyer requested retaining of my original Feb 2005 priority date.
Later when the floodgates opened in 2007, I filed for my I-485 (and my wife's) and a month later she filed her I-485 (based on her independent application and also added me as a spouse to that application).
So now we have the following situation.
1. We both have two A- numbers (Because I filed for her I-485 on my application and she filed for mine on her application)
2. We now have three different priority dates
Feb 14th 2005 my original EB2 application
Nov 2006 my EB2 re-application
June 2003 my wifes original EB3 application
Most people with Feb 2005 Priority dates have already received their Green Card approvals. I have not and we got concerned.
We contacted USCIS and they have told us that the file is "under review". We asked what Priority date are they using and the immigration officer said he cannot tell us that because the file is under review.
My questions are
1. How do I find out what priority date are they using?
2. What should I ask my lawyer to do to ensure that USCIS uses the right priority date?
3. I have an info-pass appointment on August 3 (my wife's appointment) -- what should I ask them? I went to them last week and got very little to no information. They did say my name check is complete and fingerprinting is complete, and that the case is sitting with an officer for review.
