My wife went to India for 15 days and she is coming back on sunday at EWR. She is on h1 and joining to different compnay as full time base on EAD. She is my dependent.
She went India with all original of AP approval, EAD , copy of EAD, I485, I131 (Not original) and original copy of h1b approval. She is planning to comeback on AP. Is that law that person must carry original i485 receipt when come back on advance parole.
My wife original I485 receipt is with lawyer, when I asked him about original, he said it is not required when you are coming back on AP. Copy should be fine.
Now when discussed with some freinds they said original I485 reciept required when coming back on I485. I am not sure how to handle it.

Unless the first company cancels their H1B
they don't need to cancel the H1.As he might have been already working for company B.company A might have stopped running payrol for him..so he is already out of status.

Company B Sent us an E-mail saying that they are acquiring resource group of company A.

1. This Situation can be called/categorized as Aquisition/Merger?
2. Will my I140 quilified for Successor of Interest if company B is ready to take over and sponcer GC for me?

4. What happens if my PDate (Old, and assuming that in either case I can port my PD??) is current before company B's I 140 got approved? Can I file I 485 based on my company A I140 As company A still exists???

That is not a problem at all. You can apply for EAD renewal as long as your AOS pending (i.e., I-485).

Did you write to the Ombudsman in form 7001 about 140 delay ( other thread ). I sent it yesterday. When did you file 140 at NSC ?

this is a standard reply when we enquire about a case.
I had enquired about 140 and got the same message. Then took an infopass and there the IO told there is nothing at 140 level and what I got is a standard reply .

Go to near by ASC, mostly they will do it.
Mine also same postion, I got my FP appointment for 11/13 at chicago but I went to LA ASC on 10/25 surprisingly they didn't bothered about date ,time and place they taken my finger prints right away. So go to near ASC. best of luck.

Hi there,
I changed my address using the online facility provided by USCIS by filling out the AR-11 form. I got the confirmation for that. After that when I started to change for pending petitions (I-485), lost my internet connection. I could not go back to that part again.
I checked all the FAQ's etc but could not find a link that would explain how to change only the pending petitions, since AR-11 was already changed.
Please let me know if anybody was in the similar situation.

I have question about I485, Part2, Application type.
If my I140 is pending, which type do I (principal applicatn) and my wife (spouse) have to check?
Some people said that I can check "a" and my wife can check "b".
Other people said that I can check "h" with "EB2 NIW" and my wife can also check "h" with "filing concurren

So a question that's worth pondering. If I am on 485/EAD without H1b, does this mean I have the right to work but not the right to stay in the US?
The EAD card only gives us the right to work (as said on the card, cannot be used for entry), and my 485 has been pending for more that 240 days.
Is there any explicit stipulation for the 485 that allows me to be in the US as long as it is not denied?
