Gurus,
I work for company X and in my 9th year H1-B visa. X has filed for my Eb-3 labor and I-140 and I am currently AOS (July 07 filer) on my I-485. X recently extended my H1 through Oct 2012.
I have an offer from company Y. Company Y is asking me if I want H1 extension or H1 transfer? What should I answer them. Which one ensures that I have a 3 year extension. Please advise ASAP.
Thanks.
You should tell them to file a H1 Change of Employer petition based on your approved I-140. Let them know they need to file a LCA requesting a 3 yr term and get the LCA approval and then file form I-129 requesting for a 3 yr H1.

I am working as a biomedical research fellow on a J1 visa for the last 3 years in a non-profit research institute but they cannot sponsor my H1B. I am planning to get a J1 waiver and apply for H1B as I plan to work in the private industry. I am not sure whether I can apply for H1B without an employment offer? I would appreciate any suggestions.
You can never apply for H1-B. Your employer has to petition H1-B on your behalf. So obviously you need to find an employer first with an opening (i.e., you need to find a job first).

OK.
Is there anyone who has the same status on AP and actually received the approval notice?
Thanks.
Same status for about a week. No letter yet 10/30.

I heard that GC is for a future position. If this is the case, can labor, I-140 and I-485 be filed for a person and this person join the company after labor, I-140 and I-485 have been approved? The person will join the same position mentioned in the labor cert with salary >= the labor petition.
Yes you can.

On October 2, 2009, The U.S. State Department launched the 2011 Diversity Visa Program. Between October 2 to November 30, 2009, applicants from countries around the world may register for a chance at winning one of the 55,000 immigrant visas that are drawn randomly from all eligible applicants. The State Department will notify all successful applicants between May - July 2010 of their selection. Applicants will then be able to start the visa application process in October 2010.
The State Department has announced (http://www.californiaimmigrationlawyerblog.com/Diversity%20Visa.pdf)that during the first week of registration, they have received over 900,000 entries. This reflects a 63% increase in applications over the same period last year. [/URL]

It is a case to sign in native language...
Well, if you forgot to fill the native language thing but signed the form, you don't have to worry about anything. Although the form is incomplete, the officer has no way of knowing for sure that your native alphabet is other than English... You may or may not get an RFE on this later...
Enjoy

It was my understanding that in the current context when people say "Hagel bill" they are talking about the "Hagel-Martinez" compromise on guest worker legalization, not the entire old Hagel bill.
See http://www.cnn.com/2006/POLITICS/04/05/immigration/index.html
Is there any concrete article/source that suggests this is not the case?

Hi ,
I am in strange situation. I am in 7th year of H1B and I have applied for H1B extension which was expiring on April 4th through my company on Feb 14th through normal processing. I have the LIN number from receipt notice. I was never able to check the status online as the LIN number was not found and when attorney called USCIS regarding this on March 23rd, We were told that the information will be updated to see the status online. Our attorney did not follow up with USCIS since then. Our attorney followed up again just today and found that an RFE was sent on March 25th which was never received by attorney. Currently we do not know what exactly is requested in the RFE or dead line for the response. RFE was requested again today from USCIS and was told that will be received in around 30 days. Do you think new dead line will be given for the RFE as the initial deadline might have passed for the initial RFE. I am not sure what to do at this point if I am in status or not. Please provide your advise as to what I should be doing? Appreciate your advises.
Thanks for your help.

Is it possible to ship the two I-485 pakcages to INS?
My labor and 140 already approved. My law firm preparing I-485 to submit through same day service.
In case if they are not able to do it within the time, I want to submit I-485 on Monday through same day service without telling to the law firm.
This causes duplicate submission. Can I or law firm subsequently with draw one of the I-485 later?
Please advise. Urgent. Appreciate your help.

Applied I-140 and I-485 in EB3 this month. New employer might agree to apply in EB2 category. Assuming I have to pay all costs for EB2 PERM processing, what's the average cost in Manhattan area?

Just for the information & thought would share the experience:
My wife & Daughter visited CAnada: my wife with a valid H4 stamp till Jun 2011 & my daughter with AP since she had no stamp of H4 in her passport (She had a renewed H4 I 539 but did not restamp)
While going we went to the check in counter & asked the lady at check in counter to remove the I-94's
While coming at Toronto airport my wife got the new I-94 stamped till June 2011 at the immigration counter & then she went to secondary inspection room with my daughter for her AP & I-94 stamp. Other thatn an hr of wait everything was normal. The lady at secondary inspection asked my wife if the daughter has unexpired H4 & my wife said no but she has the renewal notice till June 2011 & offered her if she (the officer) would liked to see it but she said no.
Then they had to wait for an hr as there is no token system once you submit yr papers at secondary inspection & they call you in random order near the window again. When both of them were called instead of the initial lady officer there was a guy who actually was very nice & in fact taleked to my daughter about how she liked to live in US & about the recent weather & big snow storm etc.etc & they were through to the gate for boarding!
One interesting thing though is my wife flew united & she printed the boarding passes on line with every information regarding the documents pre entered but the lady on first immigration counter said those were not the correct boarding passes & she had to go again to the check in counter & get the boarding passes again from the check in counter.
So I wonder if it is useful to web check in when you are travelling to Canada & coming back thru US immigration
Rest was all well without any issues.
Thought would help all those who wanted to know.

All,
I am currently unemployed and my spouse needs to travel to Mumbai urgently. Our AP is valid through November 30, 2009. Will there be any issues for my wife when she comes back - possibly because of my current status. Wife is employed (with a different company)& the EAD/AP was filed by my last employer. Responses will be appreciated. Thanks!

I am on the same boat. My case was transfered to NSC and my receipt number starts with WAC.
I am a July 2nd 2007 filer. When i spoke with an IO few days back, he told me that they will process according to the NSC processing dates even through the receipt # starts with WAC. The IO has also confirmed that even though the case has got two receipt dates (one with CSC RD and another with NSC RD), they will consider the first one (July 2nd) to process the case.
